Although these regions cannot create laws, they can adapt them to the peculiarities of each territory. The overseas departments and regions are: French Guiana, Guadeloupe, Martinique, Mayotte, Réunion.

The overseas collectivities were created with the reform of the French constitution in 2003 and have their own laws (statutes), which is the main difference compared to the overseas departments or regions. They are governed by local assemblies and by the French government. French Polynesia, Saint Barthélemy, Saint Martin, Saint Pierre and Miquelon and Wallis and Futuna are the overseas collectivities.

With regard to New Caledonia is a special territory, as it was granted the status of Sui Generis Collectivity in the 1998 Nouméa Accord.
